Terms of Sale

These Terms of Sale (the "Terms of Sale") govern the sale, on the website `automakion.vercel.app` (future `automakion.com`, "the Site"), of digital products (automation packs, configured AI agents, downloadable resources) and online courses, by Automakion ("the Seller") to any person making a purchase ("the Customer").

Every order implies full and unreserved acceptance of these Terms of Sale. The Customer is invited to read them carefully and to keep a copy of them.

1. Identity of the Seller

2. Products and services

The Seller offers:

  1. Digital products: automation packs, pre-configured AI agents, templates and downloadable resources. These are digital content supplied without a tangible medium.
  2. Online courses: access to educational content through an online student area.
  3. (Where applicable) services on quotation (no-code automation, web/mobile development, SaaS creation). These services may be subject to separate specific conditions.

The essential characteristics of each product/course (content, format, duration of access, prerequisites) are described on the corresponding sales page. The Seller endeavours to present these characteristics with the greatest accuracy.

3. Prices

  • Prices are stated in CFA francs (FCFA / XOF), all applicable charges included.
  • The applicable price is the one displayed on the Site at the time the order is confirmed.
  • The Seller reserves the right to change its prices at any time, it being understood that the price applied is the one in force at the time of the order.

4. Orders

Orders are placed online. The Customer:

  1. selects the product(s)/course(s);
  2. provides their details (name, email, phone number); an account is required to access a course, but not to buy a digital product or an ebook;
  3. checks the details and the total price of the order;
  4. proceeds to payment.

The sale is deemed concluded after confirmation of payment. A confirmation email summarising the order is sent to the Customer (via Resend).

5. Payment

  • Payment is made through our provider FedaPay, which handles:
  • payment by mobile money (the mobile money telephone number is required);
  • payment by bank card.
  • Payment is secured by FedaPay. The Seller neither collects nor stores full bank card data.
  • The order is only confirmed after the payment has been actually received.
  • If payment fails or is declined, the order is not completed and no access is opened.

6. Delivery and access

  • Digital products: access (download or making available) is opened immediately after confirmation of payment, or at the latest within (information being finalized), from the Customer's account or by email.
  • Online courses: access to the student area is opened immediately after confirmation of payment. The duration of access is specific to each course: it is stated on the course's sales page (description or "key points"), before the order, and forms part of the contract; it runs from the moment access is opened. If the sales page states "lifetime" or "unlimited" access, this means for as long as the course is offered by the Seller on the Site (information being finalized). Where no limited duration is stated on the sales page, access is unlimited, on the same terms. Content updates are owed only if the sales page mentions them, without prejudice to the updates necessary to maintain conformity as required by law. Access may be temporarily suspended for maintenance.
  • No physical medium is shipped.

It is the Customer's responsibility to have the equipment and an internet connection allowing access to the content.

6 bis. Digital products (ebooks)

Delivery. After payment is confirmed, the Customer receives a personal download link, shown on screen and sent by email. No account is required. The file is in PDF format. The link allows an unlimited number of downloads and stays active for as long as this ebook is offered by the Seller on the Site (information being finalized). The Customer is invited to download and keep their file upon receipt. An interrupted download or a lost link is not grounds for refusal: for as long as the ebook remains available in the catalogue, the Customer may request a new link at contact@automakion.com.

Licence. The purchase confers a strictly personal, non-exclusive and non-transferable right of use. Resale, sharing, online publication and any distribution to third parties are prohibited. A backup copy for the Customer's personal use is permitted.

Withdrawal. A consumer Customer who has ticked the dedicated box asks for the supply to begin before the 14-day period ends and loses the right of withdrawal as soon as the link is made available (art. 7.2). This agreement is confirmed to them by email. Without this box, the purchase cannot be completed.

Lack of conformity. If the file cannot be found, cannot be read or differs from its description, the Customer writes to contact@automakion.com; the Seller provides a conforming link or file within (information being finalized). Failing that, the Customer may obtain a price reduction or a refund, without prejudice to statutory warranties.

7. Right of withdrawal

7.1 Principle (consumer Customer)

Where the Customer is a consumer (a natural person acting for non-professional purposes), they are in principle entitled to a 14-day right of withdrawal from the conclusion of the contract, where the applicable regulations so provide (this is in particular the rule for European Union consumers; in Benin, the Digital Code also provides for a right of withdrawal for distance contracts).

7.2 Exception applicable to digital content and courses

In accordance with the rules applicable to distance selling, the right of withdrawal cannot be exercised for:

  • the supply of digital content not supplied on a tangible medium (digital products, downloadable resources, configured AI agents) the performance of which has begun, where the Customer has:
  1. given their express consent for performance to begin before the end of the withdrawal period, and
  2. expressly acknowledged that they thereby lose their right of withdrawal, and
  3. received confirmation of this consent and acknowledgement on a durable medium (the confirmation or delivery email);
  • a course/service fully performed before the end of the withdrawal period, or begun with the Customer's express consent and the acknowledgement of the loss of the right of withdrawal.

In practice: before confirming payment, the Customer must tick a box (not pre-ticked) by which they:

  • expressly request immediate access to the digital content / to the course, and
  • acknowledge that this immediate access causes them to lose their 14-day right of withdrawal once performance has begun.

7.3 How to exercise it (where it applies)

Where the right of withdrawal is applicable (e.g. a product for which immediate access has not been requested), the Customer may exercise it without giving reasons by writing to contact@automakion.com within the 14-day period. The refund is then made as soon as possible using the same means of payment.

8. Refund policy

  • Apart from the cases where the right of withdrawal applies (see art. 7), digital products and courses, which by their nature are accessible immediately, are not refundable once access has been opened, unless a mandatory legal provision provides otherwise or the Seller makes a discretionary goodwill gesture.
  • In the event of a technical problem attributable to the Seller preventing access to the product/course, the Seller undertakes to correct the problem or, failing that, to refund the Customer.

9. Customer's obligations

The Customer undertakes to:

  • provide accurate information when placing the order;
  • refrain from sharing, reselling, redistributing or reproducing the course content and digital products (personal and non-transferable licence of use);
  • refrain from using the Site for unlawful purposes.

Any breach may result in the suspension of access, without refund.

10. Intellectual property

The digital products and course content are protected by intellectual property law. The purchase confers on the Customer a personal, non-exclusive and non-transferable right of use, excluding any right of reproduction, public distribution or resale.

11. Warranties and liability

  • The products and courses are supplied "as is", in accordance with the description appearing on the sales page.
  • The educational content and automations are provided for information and support purposes; the Seller does not guarantee any specific commercial, financial or operational result, which depends on many factors specific to the Customer.
  • The Seller cannot be held liable for indirect damage. The statutory warranties applicable for the benefit of consumers remain applicable in all cases.

12. Complaints and mediation

  • Complaints: any complaint may be addressed to contact@automakion.com · (information being finalized). The Seller endeavours to reply as soon as possible.
  • Consumer mediation (EU consumers): if you are a consumer residing in the EU and a dispute could not be resolved amicably, you may have recourse to a consumer mediator. (information being finalized) For any complaint, the Customer may write to contact@automakion.com at any time.

13. Personal data

The processing of personal data in connection with orders is described in the Privacy Policy.

14. Applicable law and disputes

  • These Terms of Sale are governed by Beninese law.
  • For EU consumers, the more protective mandatory provisions of the law of their country of residence remain applicable.
  • In the event of a dispute, the parties will first seek an amicable solution before any legal action.

15. Acceptance

By confirming their order, the Customer declares that they have read these Terms of Sale and accept them without reservation.
